OdderTech LLC – General Terms and Conditions

  1. Product Information and Liability
    Customer agrees that OdderTech LLC is not liable for mismatched product pictures or errors in product descriptions. OdderTech LLC reserves the right to update product specifications, and those listed on the Site may not reflect the latest versions. It is the Customer’s responsibility to verify product specifications before making a purchase. OdderTech LLC is only responsible for delivering the items explicitly listed on the invoice.
     

  2. Multi-Item Purchases
    Each item in a multi-item purchase is treated independently. Any issues such as defects, replacements, or cancellations of one item do not void the entire purchase. Warranty, refund, and return policies apply to each item independently.
     

  3. Order Confirmation Responsibility
    It is the Customer’s responsibility to review their email confirmation to ensure all shipping, billing, and product details are accurate. OdderTech LLC will not be responsible for mistakes made due to incorrect customer information. For international orders, the customer is responsible for understanding and complying with local customs and import regulations. OdderTech LLC will not be held liable for customs fees, taxes, or delays due to local import laws.
     

  4. Order Cancellations
    Orders can only be canceled by speaking directly with a sales representative or managerial staff. Cancellations via email or voicemail will not be accepted. Once an order is charged, any cancellation will incur a 6.9% cancellation fee.
     

  5. Failure to Receive Order Confirmation
    If the customer does not receive an email confirmation, it is their responsibility to contact OdderTech LLC at (346) 564-5000 to confirm the order’s status. Do not place multiple orders, as this may result in additional restocking and shipping fees.

OdderTech LLC – Refund Terms and Conditions

  1. Return Window
    The return request window for standard products is 15 calendar days from the date the product was received. After this period, no return requests will be accepted for a refund. No exceptions.
     

  2. Returns for Defective Products
    Returns for defective products are only accepted after a thorough troubleshooting process, which includes remote or in-person support from OdderTech LLC. A return request can only proceed once OdderTech has verified that the product is legitimately defective. All such returns are subject to inspection and verification before any refund or exchange is processed.
     

  3. Restocking and Shipping Fees
    All returns are subject to a 20% restocking fee, covering labor for inspection, disassembly, and re-listing. Shipping fees are non-refundable. In cases where the product is deemed defective or incorrect, OdderTech LLC may, at its discretion, waive these fees. This is determined on a case-by-case basis by our team.
     

  4. Custom Machine Cancellations and Refunds

    • In the event of a cancellation or refund request on a custom-built system with a remaining balance, deposits on orders with a remaining balance are non-refundable.

    • In the event of a cancellation or refund request on a custom-built system before it is completed, a partial refund will be issued once parts have been returned to the manufacturer. We cannot refund the cost of labor. This process can take up to 45 days.

    • Refund requests on custom-built systems are eligible within 3 business days for standard orders and 1 business day for expedited orders. Beyond these timeframes, no refunds will be processed.

    • No refunds are granted for custom orders that arrive late due to shipping delays or other issues within or outside of OdderTech's control.

    • Custom build refunds will incur a 25% disassembly and restocking fee due to the labor-intensive nature of these builds.
       

  5. Return Condition Requirements
    Returned items must be unopened and in their original packaging. All accessories, cords, adapters, and documentation must be included. Returns not adhering to this will be subject to additional fees.
     

  6. Original Packaging Requirement
    Customers must return products in the original packaging. If the original packaging is not available, OdderTech will charge an additional fee for a replacement return box. Returns that arrive damaged due to improper packaging will incur a $50 labor fee, along with any costs for damaged parts, and potentially refusal of refund.
     

  7. Damaged Serial Numbers
    Returns are only accepted if the serial numbers on the product match the original item sold and are undamaged. Any tampering, obfuscation, modification, or damage to the serial number, intentional or not, voids all refund or exchange eligibility.
     

  8. Shipping Responsibility for Returns
    The customer is responsible for the cost of return shipping. The package must be insured, tracked, and properly packaged. If the product is damaged during return shipping due to improper packaging, a 20% restocking fee will still apply if a refund is requested, instead of opting for repairs. A refund cannot be issued until repairs have been completed or until the restocking fee has been processed.
     

  9. Refund Approval Process
    Once a return is received, it undergoes an inspection. OdderTech LLC will notify the customer whether the refund is approved or denied based on the product's condition. This process may take up to 45 days.
     

  10. Refund Method and Processing Time
    Approved refunds will be issued automatically to the original payment method. Please note that it may take additional time for the customer’s bank or payment provider to process and post the refund.
     

  11. Open Box Peripherals
    Peripherals, such as keyboards, mice, monitors, and headsets, that have been opened and show signs of use are not eligible for return. However, if the customer can provide clear, undeniable proof that the peripheral was defective upon arrival, they may be eligible for an exchange or return, provided they contact OdderTech within 15 days of purchase.
     

  12. Customs and Import Responsibilities
    International customers are solely responsible for ensuring compliance with local customs laws. OdderTech LLC cannot be held responsible if an item is delayed, held, or seized by customs for any reason.
     

  13. Unopened Peripherals
    Unopened peripherals are eligible for return within 15 days of receipt, subject to a 20% restocking fee. 
     

  14. Event Purchases
    Purchases made at in-person events (including but not limited to: conventions, trade shows, competitions, and exhibitions) are final and sold as-is. No returns or refunds will be accepted.
     

  15. Software Sales
    All sales of software products are final. No returns or refunds are permitted for software purchases.
     

  16. Disclaimer of Liability
    Any refund offered by OdderTech LLC is not an admission of liability but is an expression of goodwill. The maximum damages for which OdderTech LLC is liable are limited to the amount paid by the customer. By accepting a refund, the customer waives all additional claims against OdderTech LLC. While any refund offered by OdderTech LLC is not an admission of liability, OdderTech LLC is still committed to customer satisfaction and will address valid refund requests fairly and in a timely manner.

OdderTech LLC – Abandonment Clause

Customers who leave machines or devices with OdderTech LLC for evaluation, repair, or as part of a purchase are fully responsible for prompt communication and collection of their property. Failure to meet these obligations will result in forfeiture of the device under the following terms:

  1. Abandonment Timeline

    1. No Contact / No Show (90 Days): If a customer fails to communicate with OdderTech LLC in writing or verbally within 90 days of notification, the device will be deemed abandoned.

    2. Failure to Collect Devices (120 Days): If a customer communicates but fails to collect their machine or device within 120 days, it will also be deemed abandoned, regardless of reasons provided or prior arrangements attempted.

  2. Forfeiture of Ownership

    1. Upon abandonment, all ownership rights to the device are transferred to OdderTech LLC without further notice or obligation to the customer.

    2. OdderTech LLC reserves the right to repurpose, recycle, resell, or dispose of the device as it deems fit. The company is not required to retain or store the device beyond the abandonment period.

    3. Customers waive any and all claims to refunds, credits, or compensation, regardless of the device's status or any payments made.

  3. Personal Data Policy

    1. OdderTech LLC is not obligated to back up personal data stored on abandoned devices. The customer forfeits all rights to their data upon abandonment.

    2. If data backup is requested prior to forfeiture, the customer must:

      1. Pay a $60 transfer fee in advance.

      2. Purchase appropriate storage media through OdderTech LLC or provide their own, subject to compatibility approval by OdderTech LLC.

    3. Failure to request a data transfer before forfeiture constitutes an acknowledgment that any personal data on the device will be deleted, destroyed, or irretrievably lost.

  4. Final Notice and Waiver of Liability

    1. OdderTech LLC will make one final attempt to notify the customer by the preferred communication method provided (email or phone). This notice will be sent no later than 10 business days before the device is deemed abandoned.

    2. Lack of response to this notice constitutes acceptance of abandonment terms. Customers are solely responsible for ensuring their contact information is up-to-date and that they receive all communications from OdderTech LLC.

  5. Non-Negotiable Terms

  6. Customers explicitly agree that this abandonment policy is non-negotiable and legally binding, superseding any claims, objections, or appeals.

  7. Any disputes regarding abandonment or forfeiture are automatically waived upon failure to adhere to the stated timelines.

  8. By leaving a machine or device with OdderTech LLC, customers acknowledge and agree to these abandonment terms, including forfeiture of ownership and data rights after the defined period.
